Recent UK Immigration Rule Changes – Summary of Proposed Reforms and Expected Start Dates (Under Consultation)
The UK government has set out a series of proposed reforms to the immigration system. These changes are currently under public consultation and have not yet come into force. Final details may vary once the consultation concludes and the government publishes a Statement of Changes to the Immigration Rules.
The summary below reflects what has been announced so far, together with the currently expected implementation dates.
Earned Settlement System
The government has proposed a new “Earned Settlement System,” which would significantly change how applicants qualify for Indefinite Leave to Remain (ILR):
The standard qualifying period for ILR is expected to increase from 5 years to 10 years.
Settlement would no longer be automatic based on time spent in the UK; applicants would need to show continuous good conduct and evidence of integration.
A shortened route to settlement may be available where applicants meet specific criteria (e.g., higher earnings, strong English language ability, volunteering records).
A 5-year route to settlement is expected to remain available for:
Immediate family members of British citizens
Hong Kong BN(O) status holders
NHS doctors and nurses
Some groups may face longer qualifying periods, such as:
Up to 15 years for certain individuals previously admitted under the Health and Care route
Up to 20 years for people with a history of long-term reliance on public funds
Higher English Language Requirement
For applications submitted on or after 8 January 2026, the government intends to raise the English requirement from B1 to B2 under the following routes:
Skilled Worker
Scale-up
High Potential Individual
Increase in the Immigration Skills Charge (ISC)
The Immigration Skills Charge is proposed to increase by 32%, reaching £1,320 per sponsored worker per year for applications submitted on or after 16 December 2025.
This increase is still subject to parliamentary approval.
Graduate Visa Changes
For applications submitted on or after 1 January 2027:
The Graduate visa may be limited to 18 months.
The 3-year Graduate visa for PhD holders is expected to remain unchanged.
Skilled Worker Route Adjustments
Some Skilled Worker updates have already been implemented or are expected to be expanded:
The general salary threshold has increased to £41,700.
Dependants are now restricted under certain sub-categories of the route.
Further changes may be announced following the consultation outcome.
Family Members of Individuals with Protection Status
For applications submitted after 4 September 2025:
Most partners and children of individuals with protection status will need to apply under Appendix FM, unless they qualify under the Family Reunion (Sponsors with Protection) Appendix and applied before the relevant deadline.
